For the sake of argument, what if I recorded an album my own self, made
copies of it, and sold the copies. (Yeah, right, like anyone would want to
buy an album that I made.) Would there be anything wrong with that?

Well, no, because you are the artist, and you are profiting directly without
a middleman (production company and record label)

<clearing throat>

If I'm correct about which thread is mentioned above, then I shall clear
the record: It was four harmless posts, total, and all in all quite a bit
more platonic than you've made it out. Mostly, in fact, due to my
surprise at Kristina's outburst--and a joking reply the list could have
done without, but caused no harm just the same. And I hold absolutely no
love for the Reverend Kristina. :P

(but, rather, for the list's resident pirate.)

I shall apologize for any annoyance.

No; although I'd hope you copyrighted it first. It's your intellectual
property.

Ack. I meant, rather, that the origin of my existence in that thread was
due to Kristina's strange outburst. Not that the platonic nature of the
thread was due to Kristina's outburst.

Sorry. Erm. Well--to fend off those who would have my head for posting
this alone ...

A few questions about STD:

I'm told the vocals for that version of "They Got Lost" were record in a
studio, and dubbed over the live performance. Is this verifiable? It
seems pretty real to me; although I'm of course no expert on such things.

In "Battle for the Planet of the Apes" it's been said that the crowd is
yelling "singe," the French word for ape. I can't tell what they're
saying; but it's true? I've often wondered, as I heard it more as
second-hand knowledge.

And finally--the album ends with the opening to "Dig My Grave?" As in
"This Ape's for You?" <confused> My ears are dull; I don't see it (or
.. hear it, haha).

peace, love, and good happiness stuff,

jay, who stopped the bus.

I agree. I was just trying to think of an example that contradicted
Lawrence's statement (that retaining a copy of something that you sell is
illegal and immoral).

I don't think so, unless it's the children's album. The tour might be
promoting _Long Tall Weekend_, or it might be "just to pay the bills" (as
the Severe Tire Damage Tour was).

Has anyone else noticed a certain trend in songs that They cover? While
this certainly doesn't apply to ALL of Their covers, many of them seem to be
about delusion, which seems appropriate for a band with a name that
indirectly refers to Don Quixote. "New York City" is about someone thinking
that "everyone's your friend in New York City." That seems comparable to
thinking windmills are giants to me. Then there's the similarly-themed
"We've Got A World That Swings." The singer is aware that the world is a
pretty terrible place, but he's deluding himself into thinking that it's
good, because he's in love. "Maybe I Know" has a singer who isn't
recognizing the obvious unfaithfulness of his or her partner, once again due
to love. These are probably the three best examples. While trying to think
of other covers that fit this theme, I came up with the idea that "25
O'Clock" could be about someone deluding himself that 25 o'clock will
actually come. As far as I know, Andy Partridge (or Sir John Johns, if you
prefer) wasn't thinking about this when he wrote the song, but it's a
possible interpretation. Any other ideas? I'm sure that bringing songs
that TMBG wrote into it would produce many more examples, but it's
interesting that songs not even written by the band can still fit its themes
(assuming that TMBG has themes).

Nothing at all, because you own the copyright on it. Of course, depending on
how many you sold, there might some issues about running a business in your
home, but as far as selling your product, there's nothing wrong with it.

According to the Early Years Handbook, JF heard the song and thought it was
awesome, and then just covered it without asking.

And what of "Kiss Me, Son of God"? I know you said not ALL of their covers
apply to the theory, but just "how very TMBG" is this one, do you think?
Personally, it boggles my mind! :)

I don't think you have to ask, as long as you give credit to the original
artists. Of course, cub seemed to be fine with the cover, considering that
they opened for TMBG after the cover was made.

"Kiss Me, Son Of God" isn't a cover. There is plenty of delusion in that
one, though.

A bit, but the rhythm, instrumentation, and guitar solo are all

if I did), I could very well be mistaken, I admit--but I never recognized
any similarities before having them pointed out to me.

Why are you taking ethical advice from a fucking communist like Solomon?

And here's a question for you, Solomon. Why should I do what's "right"?
Because it "feels" like I should? Because of a catagorical imperative
deduced from synthetic a priori cognition? Because god said I should?

Lemming.

No, but you should do what's legal. In this case, what's "wrong" also happens
to be illegal. Where legality is *not* concerned, you should make your own
decisions, but don't you think it's generally a bad thing to take advantage of
other people like that?

On what grounds? What you're advocating isn't legal. What I'm advocating is,
because TMBG have specifically said it's ok to tape their shows, but they're
not going to go out of their way to allow it. In other words, if you get
caught at a venue that doesn't allow taping, they won't stand up for you, but
if you get out with a tape of the show, that's fine.

If you'd like, I can drag numerous people over here from

Come on, people, the pink ecto-plasm feeds off of bad vibes! (Reference
should be obvious)

Why is this list being consumed with flames, it's like Hell in here! You
can't sigh without someone questioning the very concept of sighing! What is
the point of flaming other than the struggle to be the implied "winner" of
the argument? And to use the sentence "you make me puke"? Tomatos make me
puke, and how many people do you think are making a mental note of that for
further reference? I very much doubt you absolutely needed to say that. As
for the other dude who makes the first dude puke, I'm not sure what the full
extent of the argument is, but if I have it right, the purpose of selling
their demos on the net is in the hopes that maybe they might fall into the
right hands and get them a good start in the music business, but I'm not
sure if I understand what the argument is. Anyway, I'm sure it wasn't
anything to kill anybody over.

Here's something I need to say:

Josh, you make me puke. But when I'm done puking, my stomach doesn't stop
convulsing. It keeps contracting, there's nothing to spit out but bile,
and I can't stop because the greenish acid burning my throat reminds me
that you exist. You make me want to throw rocks at puppies. You make me
want to climb a tall building and pick people off with a shotgun.

Be careful you don't accidentaly blow everyone away by your argument.

You're saying our decisions should be dictated by the masses. Giving a
haircut without a license is WRONG--amoral, unethical. Running a red light
at three a.m. when no one around is WRONG. So if congress passes a law
that says we should all kill Jews, it's wrong not to kill Jews.

Beautiful.

No, I didn't say that. I didn't say that just because it's legal/illegal it's
moral/immoral. And the converse also isn't necessarily true, because moral
issues *are* subjective, but legal ones are not. You can't argue that it's
legal to kill someone, but you can argue that your morals would allow it if it
were legal. Where there is no law governing a particular issue, you can do
whatever your personal morals dictate.

Besides, your example is totally flawed. As far as I know, with the exception
of property and money, Congress doesn't tell you anything you *must* do, only
what the government *must* do, and what we as citizens *can't* do. (The
Constitution tells the government what it can't do, pretty much)

For the most part, if it doesn't say you can't do something, then you can.

What? Public transit almost makes me puke.

Now you're going to make me puke. Tokens and transfers? Just the thought,
okay?

You wouldn't believe what happened to me today on my way to work. I passed
someone's old furniture actually sitting on the street!

Oh don't tell me - not their old couch that they sat on and stuff? If I had
seen that, I would have bent over and puked!

At some recent convention, some producers and writers for 'Space Ghost:
Coast to Coast' had a panel. Someone there recorded it, and has been posting
the transcript to an e-mail list I'm on. The Flansburgh interview was
brought up.

* ----------------------------------------------------------------------------
* -------------------------------------------------------

Fan: On the "They Might Be Giants" web site, they have a little blurb on
there where they say the rest of John Flansburgh's interview was going to
finally be seen. Is there anything, any truth to that? Are they gonna put a
show on about that, or are they just pulling our leg?

Clay: They have a web site? (laughter)

Nina: They've been calling us and asking us when it's gonna air.

Fan: Oh, they do?

Nina: Yeah, they did yesterday. (laughter)

Clay: Oddly enough.

Nina: And they're not using him in a script right now.

Fan: I mean, they actually put a picture of Space Ghost in their little
product catalog.

Would someone be kind enough to send me a copy of the song order from the
live Irving Plaza show last week.

1. I am burning a CD from the available MP3s from the show.
2. I am going to do a limited run of copies so if you want one you will need
either something I need in trade or blank media or some other offering.
3. I am looking for some very talented listee to do the jewel case graphics.
Front and back. Give yourself credit on the cover (inside) and I will send
you a free copy.
4. I am looking for someone to do a CD copy of Live In New York and Dr.
Spock's Backup Band for me. I will also trade free copies for these two
disks.

There are laws. When we break laws and are found out by law enforcement
officials, we are responsible for our actions. It's really quite simple. If you
think you're right, you get a lawyer, but if you're wrong, it probably won't
matter (unless your bootlegging has made you enough money to get a GOOD lawyer,
like Ted Danson, in "Becker: The Lawyer"! This fall on CBS!)

As if you had any credibility BEFORE you said that :P

Is it all a big joke to them?

ack. suits! Linnell looks so wrong in a suit. He also looks bored out of
his mind in that picture. :)

I bet something happened between the Space Ghost people and
TMBG. 'Cause something would've had to happen to cause that
response. It's not like you wake up one morning and say "Oh,
piss! I'm gonna have to cancel a Flans interview and mock
TMBG today!" and then have a nice breakfast.

Probably that fierce ol' temperment of Flans we hear so much
about. Or, some jerk at the SG sector. Or Don Knotts. He's a
right bastard!!!

'Fraid it can't change my feelings about SG though. Sorry, Sandwich!

Dude! that picture looks so cool. Linnel did look bored though, but Flansy
looked cool busting the moves, the set is awesome. I can't wait to see it.

No, that's not boredom! He's just awstruck that even with a new hip,
Flans
